Article 1 – PURPOSE OF THE WEBSITE

 

Within the framework of the implementation of a capital increase reserved for its employees, CREDIT AGRICOLE SA has requested the assistance of Uptevia to set up an IT platform (hereinafter the “Website”) to facilitate the collection of subscription forms from employees wishing to take part in the ACR2025 transaction (hereinafter the “Transaction”).

Uptevia allows employees and/or HR managers of the companies taking part in the Transaction, both in France and abroad, to enter individual subscriptions from employees, under their own responsibility, on a website exclusively intended for this purpose at https://www.capital.uptevia.com/acr-creditagricole

 

 

Article 2 – CONDITIONS OF ACCESS TO THE WEBSITE AND USE

 

By accessing the Website and the information contained therein, users acknowledge that they have read the general terms and conditions of use and undertake to comply with these terms and conditions. The publisher reserves the right to amend this notice at any time and in particular in order to adapt it to changes to the website.

Users therefore undertake to consult this notice on a regular basis. Users are deemed to have accepted the latest version each time they connect to the Website.

 

Conditions of access:

Users will receive their individual login/password by post with their personalised subscription pack.

If a user loses their login/password, they must contact their HR manager (or local project manager), who can identify them formally. The manager will send a written request by email to Uptevia asking them to re-send the login/password directly to the user concerned.

CREDIT AGRICOLE SA must provide Uptevia with a list of persons (HR managers or local project managers) authorised to make a login/password request for employees within their scope.

Under no circumstances will Uptevia send a login/password to a user without a written request from one of these previously identified persons.

Users are asked to ensure that they are legally authorised to connect to the Website in the country from which the connection is made.

 

Fees

Access to the Website is free, excluding internet access provision and telephone communications, the costs of which are billed directly by operators.

 

Website availability

The Website is accessible 24 hours a day, seven days a week, apart from in the case of a force majeure event, third-party factors and/or maintenance works and interventions needed to ensure that it functions correctly. Users shall be notified of any such interruption by a warning displayed on the home page or any other means. Under no circumstances may any such interruption give rise to any liability for the publisher nor to any right to compensation.

 

Time-stamping

The application records the date and time of connection by each authenticated visitor (local time in Paris, France).

 

 

Article 5 – INTELLECTUAL PROPERTY RIGHTS

 

The Website should be considered as an indivisible whole. The Website and all elements thereof (information, data, text, sound, images, drawings, charts, distinctive marks, logos, brands etc.) are the exclusive property of the publisher or its partners.

 

All these elements are subject to the provisions of the Intellectual Property Code and, in this regard, are protected against any use not authorised by law or these terms and conditions of use.

 

Reproduction of these elements is only authorised for information purposes and/or copies or reproductions intended for strictly private and personal use.

 

Any other reproduction, representation or dissemination of all or part of the Website’s contents on any medium or by any procedure whatsoever is prohibited. Failure to comply with this rule shall constitute counterfeiting, for which the parties responsible may be held liable under civil and criminal law.

 

In particular, it is strictly prohibited to use or reproduce the names “Uptevia”, “Uptevia”, “CREDIT AGRICOLE” and/or their logo, alone or together, in any way whatsoever, and in particular for advertising purposes, without the prior written agreement of the Uptevia and/or CREDIT AGRICOLE S.A.

 

Similarly, downloading or in any other way copying a piece of software or information present on the Website does not bestow any right thereto. It is strictly prohibited to reproduce this software or information (in whole or in party), transmit it (electronically or by any other means) and amend it. It is also prohibited to use the Website for public or commercial purposes without the prior written authorisation of Uptevia and CREDIT AGRICOLE S.A.

Article 6 – HYPERLINKS

 

The Website contains information made available by CREDIT AGRICOLE S.A. or hyperlinks to other websites not developed by the Publisher.

The existence on the Website of a hyperlink leading to another website does not constitute approval of the other website or its contents.

The Publisher therefore does not accept any liability for these websites, their contents, or advertisements, products or services available on or from these websites.

Furthermore, the Publisher cannot be held liable as regards the information, opinions and recommendations made by these third parties.

Any links to the Website must receive the express prior authorisation of the Publisher, which reserves the right to have such links deleted at any time.

 

 

Article 7. PROTECTION OF PERSONAL DATA

 

Users of the Website are hereby informed that the Publisher collects personal data provided via forms or questionnaires on the Website.

This data is processed by Uptevia, acting as a processor for CREDIT AGRICOLE S.A., solely for the purposes of subscription to the capital increase reserved for employees of the CREDIT AGRICOLE S.A. group.

At the end of the transaction, some personal data shall be sent to the employee savings and pensions account keeper in charge of managing the Group Company Savings Plan and/or to the party in charge of the Register of shareholders for the registration of registered shares.

In accordance with the General Data Protection Regulation that came into force on 25 May 2018, users of the Website are also hereby informed that they have a right to information, access, portability, limitation, rectification, opposition and deletion of their data.

 

Personal data is only kept for as long as is strictly necessary for the above purposes.

 

Cookies:

Users of the Website are hereby informed that, when accessing the website, information may be stored temporarily in the memory or on their hard drive in order to facilitate navigation on the website.

Users of the Website acknowledge that they have been informed of this practice and the means available to oppose such practice.
